Terms of Use

This document sets out the terms and conditions (the "Terms") under which you may access and use the websites, mobile applications, electronic kiosks and online programs, including the digital products and services available through them (collectively, the "Digital Services"), made available in the United States by Hannaford Bros. Co., LLC and its affiliates/subsidiaries (collectively, "Hannaford"). Please read these Terms carefully. By using the Digital Services, you agree to be bound by all of the Terms. If you do not accept any of the Terms, please immediately cease use of the Digital Services and do not again access or use any Digital Services. Hannaford may, in its sole discretion, revise these Terms at any time; therefore, you should visit this page periodically to review the Terms.

1. Access and Use of Digital Services

Hannaford reserves the right, in its sole discretion, to limit or terminate your access to or use of the Digital Services, in whole or in part, at any time without notice. Termination of such access or use will not waive or affect any other right or relief to which Hannaford may be entitled at law or in equity.

The Digital Services are not directed to children under the age of 13, and Hannaford does not knowingly collect personal information from children under the age of 13 via the Digital Services. If Hannaford becomes aware that it has inadvertently received personal information from someone under the age of 13 via the Digital Services, Hannaford will take reasonable steps to delete the information from its records.

2. My Hannaford Rewards Program Terms and Conditions

The My Hannaford Rewards program terms and conditions in this Section 2 (the "Program Terms") set forth the rules and limitations applicable to the My Hannaford Rewards program ("My Hannaford Rewards" or the "Program").

By participating in the Program, you specifically agree to be bound by the Program Terms. Please read Program Terms carefully and keep a copy for your records. We suggest you review the Program Terms periodically, as they may be updated from time to time.

  1. Program Eligibility

    You must be at least 18 years of age and reside in the United States in order to register for the Program. Only retail customers of Hannaford may register for the Program. Use of the Program for commercial purposes is strictly prohibited. To enroll in My Hannaford Rewards or visit your account if you are already enrolled, click here. Hannaford reserves the right in its sole discretion to decline eligibility to any party or to, in its sole discretion, terminate any party's participation in the Program. As a participant in the Program, you may be eligible for other offers and promotions automatically and without requiring that you go through an additional sign-up process. These offers and promotions will be complementary to the Program, subject to your ability to opt out by contacting Hannaford customer service.

  2. Benefits Provided by the Program

    My Hannaford Rewards allows enrolled customers to receive rewards equal to 2% of the retail purchase price of store brand products, including fresh produce, meat, seafood, deli and bakery items that have a store brand name on the packaging (including a scale label, so long as no other brand name appears on the product package). Hannaford's lineup of store brand products, which is subject to change, currently includes Hannaford, Nature's Place, Taste of Inspirations, Healthy Accents, Home360, Cha-Ching, Etos, CareOne and Companion products.

    Rewards, which may be used to save on a future Hannaford purchase, accumulate each calendar quarter and are available for use during the quarter following that during which they are received. Rewards accumulation and redemption can be tracked through an online My Hannaford Rewards account and on register receipts.

    Special promotions may allow customers to receive rewards beyond the normal 2% base.

  3. Exclusions & Limitations

    Rewards are automatically redeemed on the first qualifying purchase after online activation. If not redeemed, rewards expire at the end of the calendar quarter during which they are available for use. Rewards are received and can be redeemed only when a My Hannaford Rewards barcode is scanned or phone number entered at checkout.

    Rewards are only available on purchases at Hannaford stores of the store brand items identified in Section (b), above. Rewards are not available on purchases of milk, prescriptions or gift cards. Rewards cannot be redeemed towards the purchase of milk, prescriptions, gift cards, money orders, alcohol, tobacco, lottery tickets, stamps or other items, the discounting of which is prohibited by law. Rewards and offers cannot be earned on or redeemed from multiple accounts in connection with the same purchase.

  4. Communications Regarding the Program

    By participating in the Program, you agree to receive communications from Hannaford, including mail, email and other forms of communication, as needed, regarding the Program and concerning Hannaford offers and promotions that may be of interest to you. If you opt out of receiving emails, this may preclude you from participating and receiving the benefits of the Program. You are responsible for keeping your contact information up-to-date with Hannaford. Lost, stolen or expired rewards, coupons or points will not be replaced. Hannaford is not responsible for communications, including points, coupons, rewards or promotional offers lost due to change of address or changes in other contact information.

  5. Unauthorized Access or Use

    We are not responsible for any unauthorized access of your My Hannaford Rewards account, any unauthorized use of any rewards, coupons, points, promotional offers or other Program benefits. If you believe any such unauthorized access or use has occurred, you should notify us promptly using the contact information below in Section (l). Upon receipt of such notification, we will help you to set up a new account and transfer your existing points and rewards balance or other Program benefits (if any). However, we reserve the right, at our sole discretion, not to reinstate any rewards, coupons, points or other Program benefits which were redeemed by an unauthorized user of your account.

  6. Opt-Out of Program

    You may opt out of the Program by contacting us using the contact information below in Section (l). Once you have opted out of the Program, you may not receive additional Program benefits and available rewards and other Program benefits shall expire immediately.

  7. No Transfers

    Rewards and any other Program benefits may not be transferred.

  8. Revocation and Termination of Account or Program

    We reserve the right to cancel, terminate, suspend or revoke your rewards or Program account at any time in our sole discretion, without prior notice. Upon cancellation, termination, suspension or revocation of your rewards or Program account, you may not receive additional rewards or other Program benefits and available rewards and all other Program benefits shall expire immediately.

  9. NO CASH VALUE OR PROPERTY INTEREST

    For the avoidance of doubt, participation in the Program and receipt of Program benefits (including rewards) does not give you any property right or other ownership interest. Rewards and other Program benefits have no cash value whatsoever. Program valid only in the United States.

  10. Disclosure of Information to Third Parties

    We only share your personal identification information in accordance with our Privacy Policy.

  11. Amendments

    We may amend the Program Terms at any time by posting updated or revised Program Terms to this page. Please check back regularly for any updates or revisions to the Program Terms. Unless otherwise indicated by us, any amendments shall apply to any transactions occurring on or after the effective date of the amendments. The participation in the Program after the effective date of any amendment shall confirm that you agree to the amendment. If you do not wish to agree to an amendment, your sole recourse is to opt out of the Program in accordance with Section (f).

3. Use of Content

Content accessible through the Digital Services, such as text, graphics, images, software, features, tools and code (collectively, the "Content"), is the property of Hannaford and protected under United States and foreign copyright laws. In connection with your use of the Digital Services, Hannaford grants you a limited, non-transferable, non-exclusive, revocable license to access, view, use, print and download a single copy of the Content for your personal use, provided you do not modify or delete any copyright, trademark or other proprietary notice that appears in the Content. Hannaford may revoke this license at any time for any or no reason. Other than as expressly allowed in these Terms, any other use of the Digital Services or Content is expressly prohibited. You may not sell or modify Content or reproduce, display, distribute or otherwise use Content in any way for any public or commercial purpose. Use of Content on any other online or digital platform or in a networked environment is prohibited. Unauthorized use of Content violates copyright, trademark and other laws.

The Content we choose to make available on the Digital Services from time to time may be used solely for personal, noncommercial purposes in compliance with all laws and regulations that apply to you. We expect you to use the Digital Services responsibly and to respect the rights of others. You agree that you shall not:

  • access data not intended for you or log onto a server or an account that you are not authorized to use;
  • circumvent or modify, attempt to or assist another in circumventing or modifying any security technology or software that is part of the Digital Services;
  • interfere with service to any other user, or the software, networks or systems that we use to bring the Digital Services to you, such as by submitting a virus or overloading, "flooding," "spamming," "mailbombing" or "crashing" the Digital Services;
  • modify, alter or prepare other works based on the Content, or distribute copies of or publicly perform or display the Content, such as by posting the content on any network computer or distributing the Content on or in any media, including any effort to decompile, reverse engineer or otherwise attempt to derive source code, underlying ideas, algorithms, structure or organization of the Digital Services;
  • use or attempt to use any engine, software, tool, agent or other device or mechanism (including without limitation any type of spider, web crawler or robot) to navigate, search, and/or extract information from the Digital Services other than the search tools available on the Digital Services and other generally available third party web browsers (e.g., Netscape Navigator, Microsoft Explorer);
  • transmit or disseminate any kind of material that contains malware, viruses, bots, worms or any other computer code, files or programs that interrupt, destroy or limit the functionality or operation of the Digital Services; or
  • use the Digital Services in a manner that is inconsistent with any and all applicable laws and regulations.

Any violation of these Terms or unauthorized use of any information or materials displayed on or available from the Digital Services may violate copyright laws, trademark laws, laws of privacy and publicity and other laws and regulations and may result in, among other things, termination of your access to the Digital Services by Hannaford in its sole discretion. We have the right, but not the obligation, to remove any submitted or posted content for any reason.

4. Product and Service Images and Descriptions

We try to describe and display the features of all of the products and services shown on the Digital Services as accurately as possible; however, we do not warrant that all product descriptions, photographs, pricing or other information on the Digital Services is accurate, complete, current or entirely error-free and may make changes at any time and without notice. The colors you see will depend on your monitor and the descriptions we provide often depend on information given to us by others. In addition, the information on the Digital Services may contain typographical or other human errors and may not be complete or current despite our efforts. All weights and size dimensions may be approximations.

5. Trademarks

The names, marks and logos appearing in the Content are, unless otherwise noted, trademarks owned by or licensed to Hannaford. The use of these marks, except as provided in these Terms, is prohibited. From time to time, Hannaford makes fair use in the Content of trademarks owned and used by third parties. Hannaford makes no claim to ownership of those marks.

6. User Submissions

Hannaford welcomes your comments on our Digital Services and the Content. However, you acknowledge that if you send Hannaford creative suggestions, ideas, comments, notes, drawings, recipes, concepts, inventions or other information (collectively, the "Information"), you grant to Hannaford an irrevocable, perpetual, worldwide, royalty-free, transferable license to use, copy, prepare derivative works based on and publicly perform, display and distribute the Information you submit for any purpose whatsoever, without restriction and without compensating you in any way. You also grant and are authorized to grant Hannaford the right to use, without consideration, any name or likeness you submit with the Information. You agree that this license is effective automatically (without further action by you) when you submit the Information to us.

Obviously, you should not send us any Information that you do not want to transfer to Hannaford, or that you are legally prohibited from transferring to us, such as confidential information or product or service ideas that you intend to derive revenue from.

You represent and warrant that you own or otherwise control all the rights to the Information you submit; that the Information is non-infringing and does not otherwise violate the rights of any person or entity and conforms to all applicable laws; that use of the Information you submit does not violate any provision of these Terms and will not cause injury to any person or entity; and that you will indemnify Hannaford for all claims resulting from Information you supply. Generally, any communication which you post to the Digital Services or transmit to Hannaford over the Internet is considered to be, and will be treated as, non-confidential, subject to Hannaford's Privacy Policy.

As a user of the Digital Services, you are responsible for your own communications and are responsible for the consequences of their posting. Therefore, do not do any of the following things: transmit to Hannaford material that is copyrighted, unless you are the copyright owner or have the permission of the copyright owner to post it; send material that reveals trade secrets, unless you own them or have the permission of the owner; send material that infringes on any other intellectual property rights of others or on the privacy or publicity rights of others; send material that is false or fraudulent; send material that is obscene, defamatory, threatening, harassing, abusive, hateful, embarrassing to another user or any other person or entity or that is otherwise objectionable; send sexually-explicit material; send advertisements or solicitations of business; send chain letters, pyramid schemes, political campaigning or spam; send material containing viruses or other malware; or impersonate another person.

Hannaford is under no obligation to post, forward, transmit, distribute or otherwise provide any material available through the Digital Services, including Information you provide to Hannaford; accordingly, Hannaford has an absolute right to remove any material available through the Digital Services in its sole discretion at any time. Hannaford reserves the right to expel users and prevent their further access to the Digital Services for violating these Terms or the law and reserves the right to remove any communications from the Digital Services.

7. Infringement Notice

You are hereby informed that Hannaford has adopted and reasonably implemented a policy that provides for the termination in appropriate circumstances of users of Digital Services who are repeat copyright infringers. If you believe your copyright or the copyright of a person on whose behalf you are authorized to act has been infringed, you may notify our copyright agent:

To be effective, your notification must (i) be in writing, (ii) be provided to our copyright agent and (iii) include substantially the following:

  • A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
  • Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site;
  • Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the service provider to locate the material;
  • Information reasonably sufficient to permit the service provider to contact the complaining party, such as an address, telephone number and, if available, an electronic mail address at which the complaining party may be contacted;
  • A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent or the law; and
  • A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

8. APPLICANTS FOR EMPLOYMENT - YOUR WARRANTIES

By submission of application materials to Hannaford (including, without limitation, resumes and responses to questions set forth on our electronic applications), you warrant to Hannaford that you are at least 18 years of age and that all information submitted by you to Hannaford is true and correct. You further warrant that such materials and information is submitted in good faith and based upon a bona fide interest in obtaining employment. Your submission of a resume, online application or other related materials to Hannaford does not guarantee you employment with Hannaford or any other entity. In addition, if you are ever hired by Hannaford, your employment will be on an "at will" basis. That means either you or Hannaford may terminate the employment relationship for any reason, at any time, upon reasonable notice.

9. WARRANTY DISCLAIMER

Although Hannaford strives for accuracy in all elements of the Content, it may contain inaccuracies or typographical errors. The content of all resumes and job postings is the sole responsibility of the individual or corporate entity submitting such material to Hannaford. Additionally, while users of the Digital Services are bound by these Terms not to submit false material, Hannaford cannot be responsible for the violation of these terms by users, or for the reliance by users upon false or misleading material submitted by other users. Hannaford makes no representations about the accuracy, reliability, completeness or timeliness of Online Material or about the results to be obtained from using the Digital Services.

10. HIPAA Notice of Privacy Practices

Hannaford and its affiliates are committed to protecting our customers' privacy in connection with protected health information. Our HIPAA Notice of Privacy Practices located here describes, among other things, the privacy protections in place for our pharmacy-related services.

11. Pharmacy and Medical Content

All content provided in the pharmacy area, and all other medical information provided via the Digital Services, is for educational purposes only and is not intended to substitute for the diagnosis, treatment and advice of a medical professional. Such content does not cover all possible uses, precautions, side effects and interactions, and should not be construed to indicate that any drug is safe for you. Consult your Hannaford pharmacist and your medical professional for guidance and check the product information before using any prescription or over the counter drugs.

12. Links

The Digital Services contain links to websites owned by third parties. These links are provided solely as a convenience to you, and Hannaford is not responsible for and makes no representation regarding any linked third-party site or its content. If you decide to visit any such site using links from the Digital Services, you do so at your own risk. We encourage you to review the privacy policy and terms of use for third party sites before you visit them.

14. Miscellaneous

The Digital Services originate from Scarborough, Maine, USA. Hannaford does not claim that the Digital Services, including the Contents, are appropriate or may be used outside of the United States. Access to the Digital Services may not be legal by certain persons or in certain countries. If you access the Digital Services from outside of the United States, you do so at your own risk and are responsible for compliance with the laws of the jurisdiction from which you access the Digital Services.

These Terms are governed by the substantive laws of the State of Maine, without regard to its conflict of laws principles. You agree to submit to the jurisdiction of the courts situated in Cumberland County, State of Maine with respect to any dispute, disagreement or cause of action related to or involving the Digital Services. If any provision of these Terms is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect. No waiver of any of these Terms shall be deemed a further or continuing waiver of such Term or any other Term. Except as expressly provided elsewhere in the Digital Services, these Terms constitute the entire agreement between you and Hannaford with respect to your use of the Digital Services.
